I submit the following on the urgent representations

of the General Officer Commanding for your instructions.

A British subject resident at Canton, Hakon Schluter by name who has been in the habit of coming to Hongkong to assist in the liquidation of Reuter Brockelmann has been denied access to the Colony by me because he was suspected of evading censorship. A search was made among certain private property which had to be sent to him at Canton and a press copy of a better bearing his signature was found in which it was stated that he had been in the habit of carrying letters uncensored out of the Colony. Except this letter there is no evidence and it gives no date for the offence. The G. 0.0. has asked that steps be taken to obtain a warrant for his arrest for an offence against section 40 of the Army Act and to obtain his rendition from Canton. under the Fugitive Offendera Act.

I am advised that there is great doubt whether evasion of the censorship is an offence against the Army Act and that even if a conviction were obtained before a Court Martial it would in all probability be quashed by Habeas Corpus. I think it would be very undesirable to attempt a prosecution which would probably fail and result in the censorship being discussed in open Court. I propose therefore to take no action in the matter, but as the G.0.C. is not satisfied I submit the matter to you.
